Biz) bir âyetin hükmünü kaldırır veya onu unutturursak, ondan daha hayırlısını veya benzerini getiririz.(1) Bilmez misin ki şübhesiz Allah, herşeye hakkıyla gücü yetendir!
(1) Şer‘î ıstılahta nesh, herhangi bir hükmün yerine, sonradan başka bir şer‘î hükmün beyân edilmesi ve böylelikle, evvelki hükmün vaktinin sona ermesidir. Nesh, ebediyetine hükmedilmemiş emir ve yasaklara mahsustur. (Kurtubî, c. 1/2, 62-65) “Evet mevâsim-i erbaada (dört mevsimde) giyecek, yiyecek ve sâir ilaçların tebeddülüne (değişmesine) lüzum ve ihtiyaç hâsıl olduğu gibi, bir şahsın yaşayış devrelerinde, ta‘lim ve terbiye keyfiyeti (şekli) tebeddül eder (değişir). Kezâlik (bunun gibi), hikmet ve maslahatın iktizâsı (gereği) üzerine, ömr-i beşerin (insan ömrünün) mertebelerine göre ahkâm-ı fer‘iyede (esâsa âid olmayan hükümlerde) tebeddül (değişme) vardır. Çünki fer‘î hükümlerden biri, bir zamanda maslahat (faydalı) iken, diğer bir zamâna göre mazarrat (zararlı) olur. Veya bir ilâç, bir şahsa devâ iken, şahs-ı âhara (başka şahsa) dâ’ (hastalık) olur. Bu sırdandır ki Kur’ân, fer‘î hükümlerden bir kısmını neshetmiştir. Yani vakitleri bitti, nöbet başka hükümlere geldi, diye hükmetmiştir.” (İşârâtü’l-İ‘câz, 44)
